Marathon – A 17 year old Marathon boy is under arrest, charged with having sexual relations with a 14 year old girl.
The girl’s stepfather caught the two of them naked in bed together in the girl’s home in Marathon on the night of January 29th. He called the Sheriff’s Office to report the incident.
Detective Deborah Ryan was assigned to investigate the case. Both the victim and the suspect, Arielti Herrera, admitted to having a sexual relationship. The girl told Detective Ryan she’d been Herrera’s girlfriend since September of 2010. She said they first had sexual relations in November of 2010. Herrera said he was aware the victim was 14 years old. He said he knew her stepfather didn’t like him, so they kept their relationship a secret.
On Friday, Herrera was arrested. He was charged with two counts of lewd and lascivious behavior with the victim being between 12 and 16 years of age, a second degree felony crime. He was booked at the Monroe County Detention Center and turned over to the Department of Juvenile Justice.
I didn't know you could be arrested for statutory rape if you are a minor yourself.
